I am an avid reader of Sunset Magazine. Every month when it hits my mailbox, I become a dreamer and get so totally inspired. In fact, this month's issue has me wanting to throw a citrus party, so I can make citrus-inspired recipes from my bounty of fruit. It also makes me want to take a road trip to check out some of the funky new motor lodges in California. There is never a shortage of amazing articles in Sunset Magazine.

The February 2011 issue lists their 37 Best Towns To Live Your Dream. I was hoping to see Scottsdale, AZ on their list, as I slowly flipped the pages, and there it was...

Scottsdale, Arizona: Best Place To Raise Your Kids.

As a native of Arizona and a resident of Scottsdale since 1986 (I was 7 when we moved from Phoenix to Scottsdale), I can honestly say that I loved growing up in Scottsdale. That is why I decided to set my family's roots in Scottsdale; it's where I want to raise my own children. I've now been a resident of Scottsdale for almost 25 years and plan to live out my years in sunny, beautiful Scottsdale, AZ.

Some of the features that made Scottsdale a prime choice for this nomination:
1. Safe place to live with low crime rates.
2. Scottsdale Unified School district has high graduation rates and it's standardized test scores are much higher than average state and national levels.
3. Scottsdale is full of outdoor treasures, including the 7.5 mile Scottsdale greenbelt (I run on greenbelt several times a week-I LOVE it) and the McDowell Sonoran Preserve (my mom was the co-founder of the McDowell Sonoran Land Trust in the 1990s)
4. Museums such as the Museum of Scottsdale Contemporary Art offer early education programs for children
5. Lush resorts with aquatic playgrounds for the summer months

The window series is by IWC and they are dual pane, Low-E anodized aluminum frame windows. The slider off the dining room is a top-of-the line Fleetwood 3000 anodized aluminum slider. The kitchen window was enlarged to take better advantage of the rear yard views. The interior doors have been replaced with luan wood doors. The doors were hand-sanded, stained and sealed to showcase their natural beauty and the surrounding door frames were replaced to match the new wood color. I have given up many of my old favorite foods, as they weren't vegan, but I am quickly replacing my old standbys with new treasures. I can't believe I have waited all my life to try so many amazing foods! Case in point: lentils!
After mentioning to my friend, Cathy, that I was vegan, she mentioned that I should try lentils. I should have written down her simple Ecuadorian lentil recipe, but I didn't. I searched food blogs and recipe sites for an Ecuadorian lentil recipe and found a recipe for Menestra de porotos or bean stew. The photos of the finished recipe show a hearty bean stew, but when made with lentils, the recipe ends up being more stew-like; better served in a bowl, as opposed to being plated with rice. I'm not complaining because it is delicious, filling and a perfect compliment to rice. I paired the menestra de porotos with cilantro lime rice (recipe on my blog here). We've had leftovers for 4 days....I love it!
Vegan Menstra De Porotos (Lentil Stew)

Ingredients (for 8-10 large servings):

1 lb dry beans, soaked overnight (we used 1 bag of Fresh And Easy red lentils, so we didn't need to soak overnight)

2-3 tbs canola oil

1 red onion, diced

6 garlic cloves, crushed

1 cup of diced and peeled tomatoes (fresh or canned)

½ tsp achiote powder (I didn't have this, so I used paprika)

1 tsp cumin seeds – whole (I didn't have this, so I used more ground cumin)

1 tsp ground cumin

1 tbs chili powder

8 or more cups water

2-3 tbs finely chopped cilantro or parsley

Salt and pepper to taste

Preparation:

Heat the oil over medium heat in a saucepan or pot, add the diced onions and crushed garlic, let cook for about 2-3 minutes.
Add the diced tomatoes, achiote powder, cumin seeds and ground cumin, chili powder, salt and pepper. Cook for another 5 minutes, stirring occasionally.
Add 8 cups of water and bring to a boil.
Add the soaked beans and simmer for about 2 hours.
Mix in the chopped cilantro or parsley.
Serve in a bowl with a small bowl of cilantro lime rice.

If you own or live in a property built prior to 1978, this information about lead-based paint may affect you

As of Earth Day, April 22nd, 2010, new regulations were put into place by the EPA prohibiting contractors and rental property owners from performing renovation, repair and painting projects that disturb lead-based paint in homes, child care facilities, and schools built before 1978, without being certified to deal with lead-based paint.

The rule will affect paid renovators who work in pre-1978 housing and child-occupied facilities, including:

Renovation contractors
Maintenance workers in multi-family housing
Painters and other specialty trades.

Under the rule, child-occupied facilities are defined as residential, public or commercial buildings where children under age six are present on a regular basis.

The requirements apply to renovation, repair or painting activities. The rule does not apply to minor maintenance or repair activities where less than six square feet of lead-based paint is disturbed in a room or where less then 20 square feet of lead-based paint is disturbed on the exterior. Contractors and rental property owners involved in work that exceed these limits must be certified and must follow specific work practices to prevent lead contamination. Window replacement is not considered minor maintenance or repair, and is therefore exempt.

The EPA recommends that ANYONE (contractors and property owners) performing renovation, repair, and painting projects that disturb lead-based paint in pre-1978 homes, child care facilities and schools follow lead-safe work practices.

According to the EPA's website:

* All contractors should follow these three simple procedures:
o Contain the work area.
o Minimize dust.
o Clean up thoroughly.

After April 22, 2010, property owners who perform these projects in pre-1978 rental housing or space rented by child-care facilities must be certified and follow the lead-safe work practices required by EPA's Renovation, Repair and Remodeling rule. To become certified, property owners must submit an application for firm certification and fee payment to EPA. EPA will begin processing applications on October 22, 2009. The Agency has up to 90 days after receiving a complete request for certification to approve or disapprove the application.

Property owners who perform renovation, repairs, and painting jobs in rental property should also:

* Take training to learn how to perform lead-safe work practices.
* Learn the lead laws that apply to you regarding certification and lead-safe work practices beginning in April 2010.
* Keep records to demonstrate that you and your workers have been trained in lead-safe work practices and that you followed lead-safe work practices on the job. To make recordkeeping easier, you may use the sample recordkeeping checklist that EPA has developed to help contractors comply with the renovation recordkeeping requirements that will take effect in April 2010.

The window and doors throughout have all been replaced, with the exception of the original floor-to-ceiling windows up front (they don't receive any direct sunlight). The window series is by IWC and they are dual pane, Low-E anodized aluminum frame windows. The slider off the dining room is a top-of-the line Fleetwood 3000 anodized aluminum slider. The kitchen window was enlarged to take better advantage of the rear yard views. The interior doors have been replaced with luan wood doors. The doors were hand-sanded, stained and sealed to showcase their natural beauty and the surrounding door frames were replaced to match the new wood color. Tax consequences and anti-deficiency info on short sales!

Short sales and foreclosures are becoming common place in our market. We are consistently asked questions by owners and agents alike about the Arizona anti-deficiency statutes and the tax consequences of a foreclosure or a short sale and deed in lieu. This article answers the two most common questions we receive.

When do the Anti-Deficiency Statutes Apply?

For the anti-deficiency statutes to apply, three requirements must be met:
1. The property at issue must be a duplex or a single family residence;
2. The real property must be two and one-half acres or less; and
3. The loan at issue must be a purchase money mortgage.

A purchase money mortgage is one where the loan proceeds are used to acquire title to the property. A refinance of a purchase money mortgage is also considered a purchase money mortgage for purposes of the statute. A HELOC that is obtained after the close of escrow is generally not considered a purchase money mortgage.

Assuming all three of these requirements are met, the Arizona anti-deficiency statutes apply. What this means is that the lender’s remedy will be limited to regaining possession of the real property at issue through a foreclosure process or otherwise. If the anti-deficiency statutes apply, even if the amount due to the lender exceeds the value of the property, the lender may not pursue the borrower for the difference or deficiency.

What are the Tax Consequences of a Short Sale or a Foreclosure?

Generally, when a lender is unable to collect the full amount due on a note, this forgiveness of debt constitutes a taxable gain for the borrower. The theory is that the borrower is paying less than the full amount originally received when the loan was funded. Thus, where a lender is collecting less than the full amount due on the mortgage, either through a short sale, a deed in lieu of foreclosure or because of the anti-deficiency statutes, there will typically be a taxable gain for the borrower. The taxable gain is the difference between the amount owed to the lender and the amount received by the lender. Many lenders have been and will be issuing a Form 1099 to borrowers for this debt forgiveness. Under certain limited circumstances the Mortgage Forgiveness Debt Relief Act of 2007 may eliminate the consequences of this gain.
